Terms of Service

You must be at least 13 years of age to use the Platform (or at least 16 in jurisdictions where a higher age of consent applies). If you are under 18, you should use the Services with the consent of a parent or legal guardian. By creating an account, you confirm that you meet the applicable age requirement.

• You may create an account using an email address or Google sign-in. Your username is public — do not use information you wish to keep private.

• You are responsible for maintaining the security of your account, including keeping your password confidential.

• You may not transfer, sell, or lend your account to others.

• Each person may create only one account. Creating multiple accounts to circumvent enforcement actions or manipulate the Platform is prohibited.

• If your account is accessed without your authorization, please notify us immediately through the feedback feature.

Your Content: Content you publish on the Platform (including tank profiles, posts, photos, comments, stories, and trade listings) is generally public and can be viewed by everyone, including visitors who are not logged in and search engines.

Your Copyright: You retain copyright over your original content. By posting content, you grant Vivaloop a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, reproduce, and distribute your content on the Platform and through channels used to promote the Platform. This license remains in effect until you delete the content or your account.

Content Removal: You can delete your content at any time. However, content that has been quoted, screenshot, or cached by other users or services may still be accessible.

Prohibited Content: You may not post:

• Content that is illegal or infringes on the rights of others

• False or deliberately misleading information

• Malware or harmful code

• Other people's private personal information

• Spam, unauthorized commercial advertising, or automated content

Vivaloop is a community built around the aquarium hobby. To maintain a safe and welcoming environment, all users must adhere to the following guidelines:

• Respect each other: Treat other users with kindness. We are united by a shared passion.

• No harassment: Bullying, intimidation, stalking, doxxing, or any form of harassment is prohibited.

• No hate speech: Discrimination or hate speech based on race, gender, sexual orientation, religion, nationality, or disability will not be tolerated.

• Stay on topic: Trade listings and discussions should be related to the aquarium hobby.

• Be honest: Do not provide deliberately false information about species identification, water parameters, or care advice.

• Respect copyright: Do not post others' photos, text, or content without proper authorization.

We reserve the right to take action against accounts that violate community guidelines, including warnings, suspensions, or permanent bans.

Vivaloop offers a peer-to-peer trading matchmaking feature for aquarium hobbyists, including selling, trading, and giving away items:

Platform Role:

• Vivaloop serves solely as an information listing platform and does not participate in the actual transaction process.

• We do not process payments, arrange shipping, or hold items in escrow.

• Buyers and sellers are solely responsible for all aspects of the transaction, including payment, meetup/shipping arrangements, and item verification.

Trading Rules:

• Listing information must be truthful and accurate. Photos must depict the actual item.

• Selling protected or endangered species, or any items prohibited by applicable local, national, or international law, is strictly forbidden.

• Selling items unrelated to the freshwater aquarium hobby is prohibited.

• Fraudulent or deceptive listings are forbidden.

• Sellers should promptly update or remove listings when items are sold or no longer available.

Limitation of Liability:

• Vivaloop is not liable for any disputes, product quality issues, or losses arising from transactions between users.

• We encourage in-person meetups and thorough communication before transacting to minimize risk.

• If you encounter fraud or misconduct, please report it through the reporting feature and we will investigate.

Vivaloop's Property: The Vivaloop name, logo, interface design, source code, and related materials are owned by or licensed to the Platform and are protected by copyright and trademark law. You may not copy, modify, or distribute these materials without our written consent.

Database Content: Public information in the species, plants, and equipment databases is sourced from public domain resources (including Wikipedia and publicly available scientific databases). Photo copyrights belong to the original photographers or licensing entities and are attributed accordingly.

Infringement Reports: If you believe content on the Platform infringes your intellectual property rights, please contact us through the feedback feature with a detailed description of the infringing content.

• The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

• We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free.

• Aquarium advice: Care advice on the Platform (including water parameters, compatibility information, and care guides in the species database) is for reference only. Consult a qualified professional for actual care decisions. We are not liable for any loss of fish, plants, or equipment resulting from reliance on Platform information.

• User content: We are not responsible for the accuracy, completeness, or reliability of user-generated content.

• Trading: We are not liable for any loss or damage arising from transactions between users.

• To the maximum extent permitted by applicable law, Vivaloop shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services.

Our Rights:

• We reserve the right to suspend or permanently terminate accounts that violate these Terms of Service or community guidelines.

• Severe violations (such as fraud, sale of illegal items, or serious harassment) may result in immediate permanent suspension without prior notice.

• Less severe violations may receive a warning before escalating to suspension or termination.

Your Rights:

• You may delete your account at any time through the Settings page.

• After account deletion, we will remove your personal data in accordance with our Privacy Policy. Public content you posted may remain visible (disassociated from your account) unless you delete it individually before deleting your account.

We may modify these Terms of Service from time to time. When we make material changes, we will notify you via in-app notification at least 14 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated terms. If you do not agree with the updates, please stop using the Services and delete your account.

These terms are governed by the laws of the Republic of China (Taiwan), without regard to conflict-of-law principles. In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, both parties agree that the Taipei District Court in Taiwan shall have jurisdiction as the court of first instance. Nothing in these terms shall limit your rights under mandatory consumer protection laws applicable in your jurisdiction.
